Terms & cancellation policy
TEMPLATE – have it checked legally before you sell.
§ 1 Scope
These terms apply to the purchase of licenses for the software “Kestrel” and to booked optimization sessions via this website. Provider: [name/company as in the legal notice].
§ 2 Conclusion of contract
The presentation of the licenses is not a binding offer. By placing an order you make a binding offer; the contract is concluded when the license key is shown on your order page or sent to you.
§ 3 Service and term
The license entitles you to use the premium features of Kestrel on one PC. Depending on the plan, the term is 7 days, 30 days or unlimited (“Lifetime”). Time-limited licenses start with the first activation. A license does not renew automatically. “Lifetime” applies for the lifetime of the Kestrel product. An internet connection is required occasionally for the license check.
§ 4 Prices and payment
The prices shown at the time of purchase apply [incl. statutory VAT / or small business notice]. Payment is made via PayPal (PayPal account or card) on our checkout page, or as arranged in the order chat. The contract partner for the payment process is PayPal (Europe) S.à r.l. et Cie, S.C.A.
§ 5 Use
The license is not transferable and may not be resold or shared. Abuse (e.g. passing on the key) can lead to the license being blocked. Kestrel changes Windows system settings; every change is reversible. You use the software at your own risk and should create a restore point before making changes. Liability for slight negligence is excluded to the extent permitted by law.
Cancellation policy
Consumers generally have a right of withdrawal of 14 days from conclusion of the contract. To exercise it, a clear statement is sufficient (e.g. an email to [email]).
Early expiry: For contracts for digital content not supplied on a physical medium, the right of withdrawal expires once we have begun performance after you have expressly agreed that we begin before the end of the withdrawal period and have confirmed your knowledge that you lose your right of withdrawal by giving this consent (§ 356 (5) BGB). You give this consent with the checkbox on the website before purchasing; performance begins when the license key is shown.
[Add the model withdrawal form according to Annex 2 to Art. 246a EGBGB]
